COPYRIGHT PROTECTION OF A TITLE / WORK TITLE

The copyright protection of a title is made by the trademark act (MarkenG). In this act the work title, as it is called legally, is comprehensively protected in the §§ 5 and 15 MarkenG. According to the act, the work titles benefitting from the protection are names and special designations of:

  • printed works (books, newspapers, magazines etc.)
  • films
  • sound recordings
  • dramatic works
  • other comparable works

In general, the copyright protection of a title emerges from the use of the work title in question and the work which has been published under that title in the course of the trade. Nevertheless, even before the start of use, the copyright protection of a title can be effected by an announcement of copyright protection of a title.

Thus, the protection can be brought forward to a point in time when the work has not yet been published but is still being prepared.

A central announcement of a copyright protection of a title is not possible since there is neither any corresponding office or organisation in charge nor does a central register exist. However, a copyright protection of a title can be published with a couple of companies and publishers, respectively.
